OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: This sweepstakes is open only to legal residents of New York State who are at least twenty-one (21) years old at the time of entry. Employees of Black Button Distilling, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and voided where prohibited. Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Limit one (1) entry per person.
2. Sponsor: The Sponsor of the Sweepstakes is Black Button Distilling, 1344 University Avenue, Suite 7000, Rochester, NY 14607.
3. Timing: The Sweepstakes begins on November 1, 2024, at 12:00 a.m. United States Eastern Time (“ET”) and ends on December 31, 2024 at 11:59 p.m. ET (the “Promotion Period”).
4. How to Enter: During the promotion period, participants may enter the sweepstakes in two ways: 1) Scan the QR code on the promotional poster at participating retailers to enter online at www.blackbuttondistilling.com. 2) By emailing their entry (full name, email address, phone number, date of birth to verify age, and name of the liquor store where they saw the promotion) to Black Button Distilling at Cheers@BlackButtonDistilling.com. 3) Mail their entry (full name, email address, phone number, date of birth to verify age, and name of the liquor store where they saw the promotion) to Black Button Distilling, Attn: Barrel Cabinet Sweepstakes, 1344 University Avenue, Suite 7000, Rochester, NY 14607. No purchase is necessary to enter the sweepstakes, and a purchase of product does not increase your chance of winning. Winners will be selected at random to each receive one (1) Whiskey Barrel Cabinet.
5. Prizes: The Winners of the Sweepstakes will receive one (1) custom-made whiskey barrel liquor cabinet (alcohol not included). Black Button Distilling will coordinate pick-up of the cabinets to the randomly selected winners when the winner responds to an e-mail notification sent by Black Button Distilling. The cabinets must be picked up at Black Button Distilling in Rochester, NY and will not be delivered. No cash or other prize substitution shall be permitted. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Black Button Distilling to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.

6. Odds: Many will enter, only a few will win.
7. Winner Selection and Notification: Winners will be selected at random through collection of submitted e-mails in one of the three methods presented above. Winners will be notified via email on, or around the first week of January 2025. Winners are required to respond to the email notification from Black Button Distilling via email to indicate acceptance of winning and arrange to pick up their prize. Email response must be received no later than January 13, 2025. If Winner does not contact Sponsor, is ineligible, fails to claim the prize by the required date, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT BLACK BUTTON DISTILLING’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Publicity: Participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Limitation of Liability: By entering, You agree to release and hold harmless Black Button Distilling and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
11. Disputes: This Sweepstakes is governed by the laws of The United States and New York without respect to conflict of law doctrines. As a condition of participating in this Giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before an appropriate court having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes).
